GENERAL RULES:

Starting price determined by the seller

All items are sold to the first highest bidder

Winning bidders receive their invoice within 48 hours of auction ending

Invoice must be paid by end of day the first Wednesday following the Auction Paid

Placing a bid is a legal contract and cannot be rescinded by the bidder, unless the seller agrees to cancel that contract for a valid reason.

Bidder must be over 18 years old and must follow the law that complies with their state or country.

In the event someone doesn't want the entire lot - we will donate the remainder of the lot to a Hartist or place the remainder of the lot in a future auction - to be determined by auctioneer after auction is finished or sooner.

The host and moderators reserve the rights to remove bids, for unruly behavior or nonpayment of invoices owed

In the event two bidders of the same increments are placed first bidder (as auctioneer or dAFi designated person sees it on YouTube is honored, and if feasible shared on screen during the auction)

If the bidder does not pay by deadline, dAFi may choose what to do with the item(s).

YouTube’s algorithms, processing times, upload errors that result in further errors, delays or matters out of the control of dAFi are not the responsibility of dAFi. YouTube may not show chat in the same order, so decisions on who said “me” first or put the same bid price in at the same time, that is not the error or accountability of dAFi. Please make sure your chat is set to "live chat", which helps you see things in a closer perspective, but may still vary by how it displays the order of the bidding.

By bidding, buyer assumes all risk of the product

If an egregious error occurs, Carolyn “Care” Hart will fix it post auction.

Payment must be received prior to shipping Item shipped by shipping preference of the seller.

All products are sold as is no returns.

In no event shall Disabled Artists Foundation, volunteers, nor it’s board members be liable for damages arising in this agreement.

A bidder may authorize a proxy to bid on their behalf, If unable to attend live

Because the auction is held on YouTube, there is a delay between the bid and the live feed; therefore, each item will have time on the auction block (typically 60 or 90 Seconds). In the event there are no bids in the first 30 seconds, it is up to dAFi to cancel that lot and move on to the next lot.

If the lot number is not auction style because the item is sold in a quantity greater than 2, the winners are determined by replay of live chat after the auction closes and Carolyn “Care” Hart or volunteer reviews those lots for accuracy.. a person may say “me x 2” or whatever applies if they want more than one of the item. If there are more who say “me” than in inventory to satisfy all bidders, then items will be distributed in the invoices based on the order of live chat replay. One per person and if there are extras, then they are distributed in the quantities.

dAFi/Seller, may request assistance from moderators at the auction to gauge time, log bidders, and keep the auction moving at a swift pace.

Bidder agrees to the terms of the auction by placing a bid
